Immigration consultant bond cost

Those wishing to become immigration consultants in Utah must file a surety bond in the amount of $50,000 with the Utah Division of Consumer Protection. These one-year bonds vary in price because they are based on the applicant’s credit. If an applicant has good financial credentials they can pay as low as $500 for these bonds.

Why this bond

The Division of Consumer Protection, within the Utah Department of Commerce, requires a $50,000 surety bond under Section 13-49-201 of the Immigration Consultant Registration Act.

This bond protects any individual or group of individuals who is harmed as a result of the principal’s (immigration consultant’s) unlawful business practices. The surety will cover damages up to the full sum of the bond, and the principal must reimburse the surety for all damages paid out. Prohibited actions as an immigration consultant include, but are not limited to:

  • Making a false or misleading statement to a client while providing them services
  • Making a guarantee or promise to the client unless it is in writing and based on some fact
  • charging a client a fee for referral of the client to another person for services that the immigration consultant cannot or will not provide to the client
